SERVICE AGREEMENT

This Service Agreement is entered into between Serversium (www.serversium.com), operating under Eternal Group, and the CUSTOMER receiving the services. By using the services provided by Serversium, the CUSTOMER shall be deemed to have accepted all terms and conditions of this Agreement.

1. PARTIES

Customer:
The natural or legal person purchasing the services.

2. SUBJECT OF THE AGREEMENT

This Agreement regulates the terms of use for domain, hosting, VDS-VPS, and ready-made website services provided by Serversium.

3. SCOPE OF SERVICES

Domain Registration: The domain name shall be registered in the name of the Customer, and the right to use it shall be provided for the duration of the registration period.
Hosting Service: The server resources required for hosting websites shall be provided.
VDS-VPS Server Services: Virtual server services shall be allocated.
Ready-Made Website: Installation shall be carried out on behalf of the Customer with the specified design and infrastructure.

4. RIGHTS AND OBLIGATIONS OF THE PARTIES

4.1. Customer’s Obligations

The Customer agrees to use the services provided by Serversium in compliance with applicable laws.
The Customer undertakes to make the required payments on time throughout the service period.
The Customer agrees not to host any unlawful, harmful, obscene, or copyright-infringing content on its website or servers.
The Customer may not resell, transfer, or use the services for commercial purposes on behalf of third parties, unless otherwise specified.

4.2. Serversium’s Obligations

Serversium shall provide the necessary infrastructure to offer uninterrupted and secure service to the Customer.
It aims to provide service with 99.9% uptime for server resources.
It shall respond to customer support requests as quickly as possible.
It shall not share customer information with third parties and shall protect such information in accordance with its Privacy Policy.

5. PAYMENTS AND REFUND POLICY

Services shall be provided on a prepaid basis.
The Customer must complete the renewal process before the purchased service period expires. Otherwise, the service may be suspended or deleted.
No refunds shall be made for domain registrations and custom services once the service has commenced.
For hosting and VDS/VPS services, a refund may be requested within [X] days, depending on special campaigns and service-specific conditions.

6. SERVICE TERM AND TERMINATION

This Agreement shall remain in effect for as long as the Customer continues to purchase services.
Serversium reserves the right to suspend or terminate the service if the Customer acts in breach of this Agreement.
If the Customer wishes to terminate the Agreement before the service period expires, no refund may be claimed.

7. PRIVACY AND SECURITY

Serversium shall protect customer information within the framework of its Privacy Policy.
The Customer is responsible for keeping account information confidential. Serversium shall not be liable for damages arising from use by third parties.

8. LIMITATION OF LIABILITY

Although Serversium takes all necessary measures to provide uninterrupted service, it shall not be held liable for interruptions caused by natural disasters, cyberattacks, or technical malfunctions.
Serversium accepts no liability for data loss, commercial losses, or any other damages that may arise during the Customer’s use of the service.

9. DISPUTES AND LEGAL TERMS

Any disputes arising between the parties shall first be attempted to be resolved through negotiation.
If no resolution can be reached, the laws of the Republic of Türkiye shall apply, and the competent courts shall have jurisdiction.

10. EFFECTIVENESS

By purchasing Serversium services, the Customer shall be deemed to have read, understood, and accepted this Agreement.

11. REFERENCE USE AND PROMOTIONAL CONSENT

The Customer agrees and gives explicit consent that the website address (URL), logo, and project/company name of projects developed or hosted within the scope of services provided by Serversium may be used by Serversium for reference purposes on its:

Website

Social media accounts

Promotional, marketing, and reference materials

and may be shared with third parties, limited strictly to such information.

The information that may be shared within this scope is limited only to the following:

Website address (URL)

Logo

Project or company name

Apart from these, the following shall never be shared or used for reference purposes:

Personal data

Contact information

Private, commercial, or confidential content

The Customer may withdraw consent for reference use by providing written notice. In such case, the relevant reference shall be removed as soon as possible.
